HABA explains when and how long you are entitled to Compassionate Leave.
Compassionate Leave, which was previously known as bereavement leave, is an entitlement under the National Employment Standards where an employee can take time off if a member of their immediate family or household experiences a life threatening injury, illness or dies.
For the purposes of Compassionate Leave, immediate family is defined as an employee’s:
- Spouse or de facto partner
- Child
- Parent
- Grandparent
- Grandchild
- Sibling
Compassionate leave is not a yearly increment like annual leave or personal carer’s leave; rather it occurs per occasion in which an event such as a death or life threatening illness/injury takes place.
Employees, other than casuals, are able to access two days paid leave at their base rate for each occasion and may take the Compassionate Leave either in a single continuous period, or in two separate periods or by any other separate period of time as agreed with the employer.
Casual employees may also access two days of Compassionate Leave however this entitlement is unpaid.
